Regulatory Status

You are strongly encouraged to consult your own independent legal and regulatory counsel, the applicable scientific and clinical literature, and governmental agency databases and resources — including those maintained by the U.S. Food and Drug Administration (“FDA”) and your state medical board or other applicable state regulatory authority — for current information regarding HCT/Ps, applicable regulatory requirements, and available clinical trial data before making any independent professional decision. As of the date of this statement, the FDA has not approved any stem cell-based product for use, other than cord blood-derived hematopoietic progenitor cells for certain specified indications. HCT/Ps regulated solely under Section 361 of the Public Health Service Act and 21 C.F.R. Part 1271 are not FDA-approved products and are not evaluated by FDA for safety or effectiveness; products intended for use outside applicable homologous use may require an FDA-approved Biologics License Application, Investigational New Drug application, or other regulatory clearance. No Waiver; Modifications; Severability

OROBiologix reserves the right, in its sole discretion, to add to, delete from, or modify the Service at any time without prior notice. No failure or delay by OROBiologix in exercising any right under this statement operates as a waiver of that right. If a provision of this statement is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary to render it enforceable, or if it cannot be so modified, severed, and the remaining provisions of this statement shall continue in full force and effect. Governing Law; Venue

This statement is governed by, and shall be construed in accordance with, the laws of the State of Florida, without regard to conflict-of-laws principles. Any dispute arising out of or relating to this statement or the Service shall be brought exclusively in the state or federal courts located in Broward County, Florida, and you consent to personal jurisdiction and venue there, except where applicable law requires otherwise.
